Social Media Case Reflection #2

Ok Go is a fantastic music group that is known for their single-take music videos.  These are videos that are not pieced together and taken at separate times but one long continually recording video.  What's even crazier is the things this group does within the single-take music videos.  Usually they set up long contraptions like a marble triggering a bowling ball that hits a nail and so on.  Then they slow that video down and set it to their music.  You can also see their lips moving and lip-syncing to the lyrics of their song.  It is truly amazing to see how perfectly they can time each event in their videos.

For their video "Upside Down and Inside Out" they used an S7 zero-gravity plane.  A big problem occurred when the S7 Airlines released the video before Ok Go did.  For obvious reasons this was very wrong of the airline to post the video because simply, it was not their video to post.  An article by HNGN discusses the how Ok Go's music video on youtube was pulled.  This article can be found directly in this link here.  The video was released exclusively on Facebook only.  After the S7 Airlines saw this, they thought it would be ok to post but they did not have the appropriate authorization to do so.  Facebook got the authorization needed in an effort to get more videos up on their site.  They were trying to compete with all the videos people spend time watching on Youtube.

Quickly after S7 Airlines posted Ok Go's music video, it was taken down.  Only an error message was left and the page cannot even be found anymore on Youtube.  According to the book, "Research Handbook on Intellectual Property in Media and Entertainment" there was an attorney named Wendy Seltzer who was reviewing the case and giving her feedback.  She explained her worry with how the DMCA is impacting the first amendment.  The DMCA stands for "Digital Millennium Copyright Act".  This a United States law regarding to copyright issues.  The first amendment states, "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances. In my opinion, a lot could have been done differently.  S7 Airlines was in the wrong for posting Ok Go's music video, "Upside Down and Inside Out", on Youtube without permission.  I understand that they thought it would be ok because the video was already released on Facebook, but it was released exclusively.  The appropriate thing for S7 Airlines to do would have been to ask Ok Go about it.  Just because this rather popular music group had used their plane, does not give them any rights to releasing the video.  It was nice for the airline to give Ok Go a discount on the amount it costs to take a fly in their zero-gravity plane.  The S7 Airlines might have been blind with excitement and hope in publicizing their airline.  In the last part of the video, Ok Go recognizes and thanks the S7 Airlines for helping them to make the video and for letting them use the zero-gravity airplane.  Had the airline been more patient, they could have had a better experience and impression on Ok Go.  Also, they would not have had to deal with the legalities of posting the music video without the proper consent.
